JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer. “Wherefore, the petitioner respectfully prays that this Hon’ble Court may be pleased to; i. Issue writ of mandamus to the respondent Nos.1 and 2 to consider the petitioner representation dated 15.11.2025 and 27.01.2026 produced at Annexure-H and J respectively; ii. Issue writ of mandamus directing the respondent No.2 to transfer the RC ownership in the name of the petitioner with respect to two wheeler scooter having registered number K.A.03/AG/6526 and another four wheeler vehicle ALTO-K-10 bearing registered No.K.A.02/MN5841 forthwith. iii. Grant such other reliefs as this Hon’ble Court deems fit in the facts and circumstances of the case in the interest of justice and equity.” 2. Learned counsel for the petitioner submits that the petitioner has purchased a Car in the name of his son. It is - 3 - HC-KAR NC: 2026:KHC:25683 WP No. 13920 of 2026 submitted that he is no more and before his death, he has given Form No.29 to transfer the documents in favour of the father and the same was done by the respondent. Later basing on a representation given by daughter-in-law, the vehicle was transferred in the name of the daughter-in-law and an endorsement was given that as the daughter-in-law has already filed the suit, the parties can agitate the same before the Civil Court. It is submitted that the daughter-in-law had withdrawn the suit i.e., OS No.6483/2024. It is submitted that thereafter the petitioner has given representations to the respondent Nos.1 and 2 on 15.11.2025 and 27.01.2026. Hence, there may be a direction to the respondents to consider the petitioner's representation. 3. Learned HCGP appearing for respondent Nos.1 and 2 submits that when the daughter-in-law had withdrawn the suit, the petitioner ought to have raised the objections and when an order was passed the order should have been assailed by the petitioner. Without doing so, the petitioner cannot come before this court. - 4 - HC-KAR NC: 2026:KHC:25683 WP No. 13920 of 2026 4. Having heard the learned counsels on either side, perused the material on record. The petitioner has given a representation to the respondents dated 15.11.2025 and 27.01.2026. If the petitioner is entitled for any relief, the respondents have to consider the same and pass appropriate orders. If he is not entitled for any relief, the same should have been communicated by the respondents to the petitioner and they cannot keep the representation pending with them. In that view of the matter, without expressing anything on the merits of the matter, the writ petition is disposed of in the following manner. ORDER i. Accordingly, the writ petition is disposed of directing respondent No.2 to consider the representation dated 15.11.2025 and 27.01.2026 in accordance with law within a period of four weeks. ii. This Court is not issuing notice to respondent No.3, because respondent No.2 before considering the representation shall issue notice and give an opportunity to respondent No.3 and - 5 - HC-KAR NC: 2026:KHC:25683 WP No. 13920 of 2026 then shall pass appropriate orders on the said representation. iii.
