Hon’ble Shri Justice Narendra Kumar Vyas Order on Board 19/05/2026 1) The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as she has been arrested in connection with Crime No.08/2026 registered at Police Station Bodhghat, District Jagdalpur (C.G.) for the offence punishable under Section 21 (B) of N.D.P.S. Act. 2) Case of the prosecution, in brief is that a secret information has been received by the Police and raid was conducted in the shop of present applicant who was running a daily need shop and Police has recovered NARESH KUMAR KAMDE Digitally signed by NARESH KUMAR KAMDE Date: 2026.05.19 16:32:12 +0530 2 28 Patta (15 tabletes in each Patta = 420 tablets and 0.16 GM weight of each tabletes i.e. 0.16 x 420 = 67.2 GM) of the contraband Alprazolam IP 0.5 MG Becalm 0.5 from the possession of the present applicant. The panchnama was prepared and it was found that the 67.2 GM of contraband was found, which is more than the commercial quantity and after usual investigation, charge-sheet has been filed against the present applicant. 3) Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in this case. He further submits that the applicant is old aged lady about 57 years, she is in jail since 08/01/2026, charge- sheet has already been filed and the trial may take some time, therefore, she may be released on bail. 4) On the other hand learned counsel for the State opposes the bail application and submits that the applicant has three previous criminal antecedent, out of which two cases have been registered under NDPS Act and one case is under Excise Act. He would further submit that the applicant was selling the narcotic drug Alprazolam without any license, which is heinous offence, therefore her bail application may be rejected. 5) I have heard learned counsel for the parties and perused the materials available on record. 6) Looking to the fact that prima facie material is available against the present applicant and looking to the huge quantity of the contraband seized from the possession of the applicant which is more than the commercial quantity, looking to the gravity and seriousness of the 3 offence its impact on the Society, I am of the view that the applicant is not entitled to be released on bail. 7) Accordingly, bail application is rejected.
