The petitioner herein has assailed the order dated 8th April, 2026 by which, the court below had issued warrant of arrest against the present petitioner after rejecting his prayer for adjournment. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that due to his personal difficulties, he could not attend the court on the date fixed but the court below had issued warrant of arrest against the present petitioner without giving surety an opportunity to produce the accused on the next date. Petitioner herein seeks liberty to surrender before the court below. Having heard learned counsel for the petitioner and the opposite party, it appears that the prayer made by the petitioner is innocuous and is required to be allowed to secure the ends of justice. In view of above, CRR 1769 of 2026 is hereby disposed of by giving liberty to the petitioner to surrender before the court below within a period of two weeks from this date and in the event of such surrender, the court below will dispose of his
2 prayer in accordance with law without being influenced by any observations made herein. The impugned order dated 8th April, 2026, which pertains to the issuance of warrant of arrest against the petitioner, is hereby stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier.
