Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with Attabira P.S. Case No.164 of 2026 corresponding to Special C.T. (Special) Case No.32 of 2026 pending in the file of learned District and Sessions Judge-cum-Special Judge, Bargarh on the grounds stated. 4. Perused the FIR as at Annexure-1. The Court finds that a case has been registered for the offences punishable under Section SC & ST (PoA) Act. Recorded the submission of learned counsel for the petitioner and objection of the State. Considering the nature of allegation revealed from Annexure-1 and the alleged involvement of the petitioner, this Court is inclined to direct him to surrender before the learned court p. 2 below seeking regular bail for its consideration in the light of the decision of this Court in Pramod Kumar Ray and others Vrs. State of Odisha (2017) 67 OCR 309. 5. Accordingly, it is ordered. 6. In the result, both the ABLAPLs are disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned District and Sessions Judge-cum- Special Judge, Bargarh within three weeks from today and moves application for bail, it shall be considered in connection with C.T. (Special) Case No.32 of 2026 corresponding to Attabira P.S. Case No.164 of 2026 and disposed of as per the decision in Pramod Kumar Ray (supra) with a proper notice to the informant and till his surrender, it is directed that he shall not be arrested by the local police. 7.
