IN THE HIGH COURT OF ORISSA AT CUTTACK
ABLAPL No. 1838 of 2026
Mithun Mandal …. Petitioner
Mr. M. K. Chand, Advocate
-Versus-
State of Orissa …. Opposite Party
Mr. S. Panda, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 30.03.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with Digapahandi P.S Case No.235 of 2023 corresponding to G.R. Case No.1312 of 2023 pending in the file of learned J.M.F.C. (R), Berhampur on the grounds stated.
3. Perused the FIR as at Annexure-1. The petitioner had approached this Court in ABLAPL No.6974 of 2024 disposed of on 22nd July, 2024 with a direction therein for him to surrender before the learned court below seeking regular bail and in case of rejection, to move the learned Sessions Court. Today, Mr. Chand, learned counsel for the petitioner submits that in the meantime, some of the co-accused persons have been granted bail by the learned court below, hence, in view of the aforesaid development, the petitioner should be directed to
surrender before the learned J.M.F.C. (R), Berhampur demanding release pleading parity. Recorded the objection of Mr. Panda, learned ASC for the State. Notwithstanding, the earlier order in the ABLAPL as at Flag-B, this Court is inclined to allow the petitioner to surrender before the learned court below seeking regular bail pleading parity in view of release of the co-accused persons in the meantime.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders within a fortnight from today and moves an application for regular bail, it shall be entertained by learned J.M.F.C. (R), Berhampur during the first hour and in the event of rejection, he shall approach the learned Sessions Court for orders on the same day during the second hour itself for appropriate order considering his plea for parity.
6. Issue urgent certified copy of this order as per rules.
