State Of Rajasthan, Through Public Prosecutor. 2. Victim ----Respondents Connected With S.B. Criminal Miscellaneous Petition No. 5372/2024 Ravindra Kumar Meghwal S/o Babulal Meghwal ----Petitioner Versus State Of Rajasthan through PP & Anr. ----Respondents For Petitioner(s) : Mr. Chandra Shekhar For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE SUDESH BANSAL Order 13/02/2026 In Criminal Misc. Application No.693/2024: This criminal misc. application filed by the accused-petitioner to recall the final order dated 14.05.2024 dismissing S.B. Criminal Misc. Petition No.2861/2024 is dismissed as not pressed. In S.B. Criminal Misc. Petition No.5372/2024: 1. This criminal misc. petition comes up on misc. application I.A. No.1/2024 seeking to waive the defect pointed out by Office. [2026:RJ-JP:7116] (2 of 2) [CRLMA-693/2024] 2. Counsel for the accused-petitioner submits that it is true that petitioner has already filed S.B. Criminal Misc. Petition No.2861/2024 seeking to quash FIR No.201/2024 registered at Police Station Muhana, District Jaipur City (South) for the offences under Sections 376-D, 379 and 384 IPC and that petition has been dismissed vide order dated 14.05.2024 but thereafter, police submitted negative final report No.250/2024 on 07.08.2024 and FIR was consigned to record but again, after obtaining administrative instructions of higher officers, investigation has been reopened, hence, in such changed circumstances, this fresh S.B. Criminal Misc. Petition No.5372/2024 has been filed, which deserves to be heard and decided on merits. His prayer is that defect No.1 pointed out by Office be waived. 3. Learned Public Prosecutor has placed on record the current status report dated 03.12.2025 in the impugned FIR and submits that it is true that investigation in the FIR was closed and FIR was consigned to record on 07.08.2024, but again the investigation has been reopened. The status report dated 03.12.2025 is taken on record. 4. Since the present criminal misc. petition is based on change in circumstances and on accrual of fresh cause of action, in that view, defect No.1 pointed out by Office is waived. 5. Application (I.A. No.1/2024) stands allowed. 6. Office to proceed and list this criminal misc. petition before the Bench having regular roster. (SUDESH BANSAL),J AARZOO ARORA /7-8 S.
