Heard on application for condonation of delay in filing of the review petition bearing REVP No. 138/2026. 2. Counsel for petitioner submits that as the Registry has not pointed out delay in filing of the review petition, hence, he is not pressing this 5 application(s) for condonation of delay and seeks permission of this Court to withdraw the application(s). 3. Submission made by learned counsel for petitioner is not opposed by the learned counsel for the respective respondents. 4. On due consideration of the submissions of the counsel for the petitioner, he is permitted to withdraw application(s) for condonation of delay. 5. With the consent of the parties, cases are heard finally and disposed of by way of this common order. 6. Petitioners have filed this review petition seeking review of the order dated 17.09.2025 passed in WP (C) No. 143/2016, WP (C) No. 1097/2016, WP (C) No. 144/2016, WP (C) No. 147/2016, WP (C) No. 148/2016 and WP (C) No. 158/2016. 7. Learned senior counsel for the petitioner would submit that this Court had allowed the writ petitions filed by the respective petitioners. By the impugned order dated 17.09.2025, the award dated 18.09.2015 subject matter of writ petition is quashed in its entirety. The order is not made only with respect to the petitioners therein. The award dated 18.09.2025 was challenged only by some of the persons by filing writ petitions and not by all whose lands were acquired by that award, because they were not aggrieved and therefore, the benefit of the order ought to have been made limiting to the petitioners only. 8. He contended that if the entire award is to be set-aside, it will cause disturbance to the continuous development of the consolidated unified planning of Naya Raipur Atal Nagar, and would also cause great loss to the public exchequer. 9. Submission made by the counsel for petitioner to that extent of making the order passed in writ petitions to be in personam, is not opposed by the counsel for respective respondents. 6 10.I have heard the arguments raised on behalf of the parties and perused the record.. 11.It is the petitioners only who have raised grievance and challenged the award dated 18.09.2025 (Annexure P/1) by filing respective writ petitions. The benefit to be accrued from the land acquisition proceedings was in personam and therefore, if for any of the reasons, the writ petition is to be allowed, it is to be with respect to the petitioners therein before this Court only. In above facts of the case, I find it appropriate to allow these review petitions in part and it is ordered that the last two lines of Para 15 of the order dated 17.09.2025 “Therefore, impugned award, Annexure P-1, is not sustainable and is liable to be quashed” is deleted. 12.Similarly, in Para 16 in first line “Impugned award dated 18.09.2015” is hereby quashed be read as ‘Impugned award dated 18.09.2015 is hereby quashed, so far as it relates to the petitioners’. 13.Review petitions are allowed to the extent as indicated above. Registry is directed to make this order as part of the record of the writ petitions i.e. WP (C) No. 143/2016, WP (C) No. 1097/2016, WP (C) No. 144/2016, WP (C) No. 147/2016, WP (C) No. 148/2016 and WP (C) No. 158/2016.
