Jayashree Dari ……for the respondent no.4 The petitioner and the private respondent are the co- sharers in respect of the plot in question. The petitioner alleges that the private respondent has raised unauthorised construction therein without obtaining sanction from the Panchayat. It appears from the report submitted by the Panchayat that by a resolution taken on January 30, 2019, sanction/ permission has been accorded to the private respondent for raising construction in the plot in question in terms of which the alleged construction has been raised. In view of the above, this Court is inclined to hold that the writ petition is devoid of merits and is accordingly dismissed. In the event the petitioner is aggrieved by the resolution taken by the Panchayat, he is at liberty to take necessary steps in accordance with law. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
