The instant application has been filed for condonation of 358 days delay in filing the present appeal. As per the averments as made in the application, the impugned
order was passed on 15.01.2025. The certified copy of the
order was applied by the learned counsel for the applicant on 23.06.2025 and the same was completed on 27.06.2025 and delivered on 02.07.2025. As per the case of the applicant, it contacted the counsel in order to procure the certified copy as well as the record and finally procured the same in the month of August 2025. Unfortunately, the counsel for the applicant met with an accident and was advised to have complete bed rest on the advice of attending doctors. In the said process, the delay has occurred in filing the appeal, which is neither intentional nor willful, but the same has occurred under unavoidable circumstances.
Learned counsel for the non-applicants have no objection in case the application is allowed
Consequently, in view of the averments made in the application, especially paragraphs 2, 4 & 5, which is duly supported by an affidavit and in view of submissions as made by learned vice counsel for the applicant, the present application is allowed and delay in filing the appeal is condoned.
Accordingly, the application stands disposed of.
