The petitioner is serving as Inspector of Police (Telecom/Technical) under the West Bengal Police Force. He claims that he is ranked in serial no.1 in the gradation list. 3. He prays for a direction upon the respondent authorities to promote him to the post of Deputy Superintendent of Police (Telecom/Technical) before his superannuation on 31st May, 2026. 4. Learned advocate for the respondents opposes the prayer of the petitioner. It has been submitted that the petitioner has approached this Court seeking promotion at the fag end of his service career. An employee cannot compel the employer to promote him on and from a particular date. 2 5. The prayer of the petitioner cannot be allowed in view of the settled position of law that promotion cannot be claimed as a matter of right. An employee certainly has a right to be considered for promotion but cannot seek issuance of a Writ of Mandamus directing the respondents to grant promotion to him only because he is graded at serial no.1 in the gradation list and is due to be superannuated shortly. 6. The writ petition fails and is hereby dismissed. 7. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 8.
