Ms. Anjali Patil for Applicant. Mr. Sagar Agarkar, APP for Respondent/State. PSI-Harish Patil, Kashigaon Police Station, present. ****
CORAM : M.M. SATHAYE, J.
DATE : 16th OCTOBER, 2026 P.C. :
1.
Learned counsel for the Applicant fairly submitted that after the impugned order is passed (rejecting discharge application) charges are already framed.
2. Learned APP has relied upon judgment of Directorate of Revenue Intelligence Vs. Raj Kumar Aroa & Ors. (Criminal Appeal No.1319 of 2023 with connected appeal, Judgment dated 17.04.2025, Supreme Court) contending that once charges are framed, the only option available under the procedure is either to convict or acquit the accused.
3.
Learned counsel for the Applicant therefore, seeks leave to withdraw the application.
4. Revision application is accordingly dismissed as withdrawn.
