This is a second round of litigation which has been initiated by the petitioner. 2. The grievance of the petitioner is directed against inaction of the authorities in providing separate electricity connection to the premises of the petitioner. 3. In a prior writ petition being WP 13060 (W) of 2019, a Co-ordinate Bench had disposed of the writ petition directing the District Magistrate to consider the grievance of the petitioner and complete the entire process of inspection after hearing all the parties. Pursuant to the order dated 20 August 2019, the District Magistrate had heard the parties and passed an order on 11 March 2026 directing 2 the petitioner to purchase 104 sq. feet for installation of an electricity connection. 4. It is fairly admitted by all the parties that the order of the District Magistrate on 11 March 2026 directing the petitioner to purchase an additional 104 sq. feet is neither viable nor practical. The private respondents from who the petitioner had been directed to purchase the 104 sq. feet is neither ready nor willing to sell the premises to the petitioner. 5. In view of the above, the order dated 11 March 2026 stand set aside. The District Magistrate, Howrah is directed to hear the parties afresh including the WBSEDCL and pass an order as to whether the grievance of the petitioner for a separate electricity connection is practical or not. 6. It is made clear that there has been no adjudication on the merits of the case and all issues are left open to the District Magistrate to decide afresh in accordance with law. 7. The above exercise is to be completed within a period of eight weeks from the date of communication of this order. The District Magistrate is also directed to consider the representation of the petitioner and communicate the same to all the parties. 3 8. With the above directions, WPA 10845 of 2026 stands disposed of. (Ravi Krishan Kapur, J.)
