Ms. Busra Khatun …for the petitioner. Mr. Pritam Roy …amicus. 1. Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, there is no other incriminating material available against the present petitioner. Charge sheet has been submitted. 2. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He submits that as per the memo of evidence, a copy of which is taken on record, there are criminal antecedents against the present petitioner involving offences under the provisions of the NDPS Act. In fact, the petitioner is part of a big racket dealing with Yaba tablets and other contraband. Some of them are smuggled to Bangladesh. 3. Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner. 2 4. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
