JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners – accused Nos.1 to 5 are before this Court calling in question proceedings in C.C.No.60279/2005, pending before the XXIX ACJM, Mayohall, Bengaluru, for the offences punishable under Section 85 of the BNS and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 in unison submit that the parties to the lis were before the family Court in M.C.No.1105/2025 and have settled their matrimonial dispute amicably by drawing up certain terms and conditions before the mediation center and have parted their ways. Therefore, they are before this Court seeking permission to compound the offences. They have filed a joint affidavit before this Court to that effect. 3. The joint affidavit reads as follows: “3. The said Petition was referred to Karnataka Mediation Centre and Memorandum of the Settlement under Section 89 of CPC Read with Rules 24 and 25 of the Karnataka - 4 - HC-KAR NC: 2026:KHC:13052 CRL.P No. 2769 of 2026 Civil Procedure (Mediation) Rules 2005 was signed by both of us, by an order dated 15.12.2025 of the I Addi Family Court, Bangalore, the marriage solemnized on 14.08.2021 at Bethel House of Prayer, B.M. Road, Robertsonpet, K.G.F. between us came to be dissolved. 4. We the parties have a female child born to us from the wedlock namely Adina Beril aged about 3 years presently is in the custody with the Mother/Second. The First of us has given up/not insisting his visitation right over the minor child. The absolute custody of the child shall be with the Mother/Second of us and without any interference from the First of us. 5. The First of us agreed to pay a sum of Rs.18,00,000/- (Rupees Eighteen Lakhs Only) to the Second of us toward permanent alimony/maintenance in full and final settlement of all our claims. Out of which a sum of Rs.8,00,000/-(Rupees Eight Lakhs Only) by way of demand draft bearing No.076642 dated: 10.11.2025 drawn on SBI, K.G.F. Branch, in favour of the Second of us was handed over by the First of us before the I Addl Family Court, Bangalore on 15.12.2025 while concluding of the divorce proceedings between us. The remaining balance amount of Rs. 10,00,000/- (Rupees Ten Lakhs Only) was agreed to be paid before this Hon'ble Court in the 482 proceedings to be filed seeking to quash the proceedings in CC No.60279 of 2025 filed under Section 498A,34,504 IPC by the Second of us. 6. The First of us is hereby handing over a Demand Draft bearing number 076836 dated 27.02.2026 drawn on State Bank of India, KGF Branch for a sum of Rs. 10,00,000/-(Rupees Ten Lakhs Only) to the Second of us before this Hon'ble Court, towards full and final settlement. 7. In view of the above terms of the settlement the Second of us agrees to withdraw the Crl. Misc. No.22/2025 pending on the file MMTC-1 Mayo hall Court, Bengaluru as not pressed and that the First of us agrees - 5 - HC-KAR NC: 2026:KHC:13052 CRL.P No. 2769 of 2026 to withdraw Crl. Appeal No. 25112/2025 pending on the file of CCH-74, Mayo hall Court, Bengaluru as not pressed. 8. Apart from the above both of us have agreed that they will have no claims of maintenance/permanent alimony against each other. We state that we have already exchanged our valuable articles belonging to each other. 9. We jointly state that we have no other claims of whatsoever against each other with regard to permanent alimony/maintenance either past, present or future and also have no claims over the moveable or immovable properties belonging to each other either existing at present or to be acquired in future. 10. We agree that we shall not interfere in the lives of each other in future, we will not go the residence of the other or try to meet the other in person or try to contact the other, by any mode of communication, including online/social media. The Child will be in the absolute and permanent custody of the Mother/Second of us, without any rights of visitation to the Father/First of us. 11. We from the above mentioned cases state that there are no cases pending before any court filed by us against each other. Wherefore, we jointly submit that we have settled our differences and disputes in terms of Memorandum of Understanding dated: 15.12.2025, before the Bangalore Mediation Centre, for mutual interest and better welfare and future and prays for this above petition to be allowed filed seeking quashing of proceedings in CC No.60279 of 2025 filed under Section 498A,34,504 of IPC. In the light of the fact that the parties have arrived at settlement and since it is a marital dispute, I deem it appropriate to accept the joint affidavit and terminate the - 6 - HC-KAR NC: 2026:KHC:13052 CRL.P No. 2769 of 2026 proceedings against the petitioners, as the allegations are not against the State. 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings in C.C.No.60279/2025, pending before the XXIX Additional Chief Judicial Magistrate, Mayohall, Bengaluru, stand quashed.
