P.P. …...... 02/ 24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 376(3) of IPC and under Section 4/6 of the PCCSO Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. There is allegation of sexual assault upon the victim, who is aged about 13 years. The accused is of 32 years. The earlier bail was rejected. Further, I find that the victim has already been examined as P.W.-1, who supported the prosecution case. 5. Considering the aforesaid fact, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Sariya P.S. Case No.88 of 2022, (Special POSCO Case No.152 of 2023) pending in the Court of learned Special Judge POCSO Act, Giridih stands rejected.
