The petitioner is apprehending his arrest in connection with Hindpiri PS Case No.43 of 2026, for offence registered under section 30, 21(a) and 22(b), 29 of NDPS Act, pending in court of learned Judicial Commissioner Cum Special Judge, NDPS, Ranchi. 3. Learned counsel for petitioner submits that the petitioner was not present on the spot and the allegations are made that from the house of the petitioner 260 grams of Ganja has been recovered. He next submits that mother of this petitioner has already been arrested. He next submits that the quantity of said Ganja is very small and it is less than one kilogram and in view of that the punishment is prescribed for one year only. 4. Learned State counsel opposes prayer and submits that from the house of the petitioner the recovery has been made. 5. Considering that the mother of the petitioner has been 2026:JHHC:20709 2 arrested for the alleged recovery from the house and the said Ganja is less than one Kilogram and for one kilogram of Ganja the maximum punishment is prescribed for one year, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Commissioner Cum Special Judge, NDPS, Ranchi, in connection with Hindpiri PS Case No.43 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
