JUSTICE ANUROOP SINGHI Order 21/01/2026 The present application No.246/2023 has been filed seeking recall of the order dated 05.12.2023, which reads as under :- “Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to approach the Revisional Authority for early disposal of the stay application. The petition is disposed of with liberty as prayed for.” [2026:RJ-JP:2659] (2 of 2) [WMAP-246/2023] Learned counsel, Mr. Anurag Sharma, appearing on behalf of the petitioner, submits that the said order has been inadvertently passed, as no such request was made by him when the matter was listed on 05.12.2023, as even the submissions recorded in the order do not support the facts of the case. Learned counsel for the petitioner further submits that the prayer made by him before the Court on 05.12.2023 seems to have been inadvertently typed in the matter which was listed just below the present writ petition and thus, for the above mentioned reasons, the present application deserves to be allowed and the order dated 05.12.2023, deserves to be recalled. The aforesaid submissions are not disputed by learned counsel, Shri Asgar Khan, appearing on behalf of the respondents, who was also present when the order dated 05.12.2023 was passed. The Court appreciates the fair submissions made by learned counsel, Shri Asgar Khan and considering the above factual matrix, the order dated 05.12.2023 is recalled and consequently, the writ petition being S.B. Civil Writ Petition No.21553/2019 stands restored. Accordingly, the application stands disposed of. (ANUROOP SINGHI),J DIKSHA MISHRA /9
