JUSTICE HARISH KUMAR ORAL ORDER 4 24-06-2026 Heard Mr. Amar Nath Yadav, learned Advocate for the petitioners and the learned Additional Public Prosecutor for the State. 2. The petitioners are apprehending their arrest in connection with Raghopur P.S. Case No. 363 of 2025, registered for the offences punishable under Sections 137(2), 96, 351(2), Patna High Court CR. MISC. No.17143 of 2026(4) dt.24-06-2026 2/4 352 and 3(5) of the B.N.S., 2023. 3. Allegedly, the daughter of the brother in law of the informant had left her house to bring some articles and when she did not return till evening, search was made but her whereabouts could not be found out. Later on, the informant received a call on his mobile and the victim girl informed him that she left her house along with co-accused Durganand Kumar @ Guddu Yadav. When the informant and his family members went to the house of the co-accused Durganand Kumar @ Guddu Yadav the petitioners, who happen to be the family member of co-accused abused and assaulted them. 4. Learned Advocate appearing on behalf of the petitioners submits that from the reading of the FIR it is evident that earlier also co-accused Durganand Kumar @ Guddu Yadav has allegedly enticed away the victim for which Nadi P.S. case no. 25 of 2024 was instituted. So far the present case is concerned, allegedly the victim voluntarily left her house on 13.09.2025 but the present case came to be instituted on 15.09.2025 Even if the allegation is taken to be true for the sake of argument, the specific accusation has been leveled against the co-accused Durganand Kumar @ Guddu Yadav. During the course of investigation the victim was recovered and her Patna High Court CR. MISC. No.17143 of 2026(4) dt.24-06-2026 3/4 statement was recorded under Section 183 of B.N.S.S. wherein she has not made any allegation against these petitioners. The petitioners bear one criminal antecedent however, this case was also instituted by the informant against them when the victim had eloped with co-accused Durganand Kumar @ Guddu Yadav. 5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submits that the victim was enticed away with the help of the petitioners who are the family members of the co-accused Durganand Kumar @ Guddu Yadav and as such their complicity cannot be denied. Moreover, the victim is a minor girl. 6. Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the fact that the petitioners are none else but the family members of co-accused Durganand Kumar @ Guddu Yadav who has allegedly enticed away the daughter of the brother-in- law of the informant coupled with the fact that the victim has already been recovered and she has not made any allegation about the complicity of these petitioners, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon Patna High Court CR. MISC. MISC. No.17143 of 2026(4) dt.24-06-2026 4/4 furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Birpur in connection with Raghopur P.S. Case No. 363 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner. sumit/- (Harish Kumar, J) U T
