Mr. Narayan Chandra Ghosh. …..for the petitioner. 1. This revisional application assails an order dated March 02, 2024 passed by the learned Additional District Judge, Fast Track Court-I, Alipore, 24-Parganas (South) in Misc. Appeal No. 50 of 2021. 2. The petitioner has instituted a suit for declaration and permanent injunction. In the said suit, the petitioner filed an application for temporary injunction and pressed the same for ad- interim orders. Such prayer was rejected by the learned Trial Court. Feeling aggrieved thereby, the petitioner has filed Misc. Appeal No. 50 of 2021 before the leaned Appellate Court. 3. In the said misc. appeal, the petitioner filed an application under Section 151 of the Code of Civil Procedure, 1908, praying inter alia for an order of injunction restraining the opposite parties from transferring and/or alienating and/or encumbering such property. Such application has been turned down by the learned Appellate Court 2 and the misc. appeal itself has been fixed for hearing. 4. Having heard the learned Advocate appearing for the petitioner and having perused the material-on-record, this Court is of the view that since the appeal which is pending before the learned Appellate Court is ready for hearing, justice would be sub-served if the learned Appellate Court is requested to dispose of the appeal itself within a specific time frame. 5. Accordingly, the learned Appeal Court is requested to dispose of Misc. Appeal No.50 of 2021 as expeditiously as possible and preferably within a period of one month from the next date fixed without granting any unnecessary adjournment to either of the parties. The petitioner is granted liberty to produce all documents in support of his case before the learned Appellate Court. The costs that have been imposed on the petitioner by the order impugned to the tune of Rs.2,000/- are waived. 6. C.O. 3740 of 2025 stands disposed of. No costs. 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
