JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed questioning the order dated 09.02.2026 and 30.04.2026 passed in I.A.No.1 in O.S.No.219/2026 by the III Additional Senior Civil Judge, Bengaluru Rural. 2. Office has raised objection with regard to the maintainability of this writ petition. 3. Learned counsel for the petitioner/defendant submits that the petitioner has a right of appeal. However, the petitioner has come before this Court as the trial Court had failed to consider the application filed by the petitioner/ defendant seeking to vacate the injunction that is granted and - 3 - HC-KAR NC: 2026:KHC:26198 WP No. 15467 of 2026 though the trial Court had observed that the objections are not filed by the plaintiff, still the matter was adjourned. It is submitted that from the last four months, injunction is operating against the petitioner herein and still the trial Court is not taking up the matter. 4. Having heard the learned counsel for the petitioner, perused the office objections. Office has rightly raised objection with regard to the maintainability and the same is sustained. However, considering the argument of the learned counsel for the petitioner, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of directing the trial Court to consider the I.A. that is filed by the defendant to vacate the injunction granted in favour of the plaintiff on the next date of hearing without further adjourning the matter. ii. This Court has not issued notice to the respondents as no adverse orders are passed against them. - 4 - HC-KAR NC: 2026:KHC:26198 WP No. 15467 of 2026 iii.
