JUSTICE P SREE SUDHA ORAL JUDGMENT These appeals are filed by the appellant/KSRTC under Section 173(1) of Motor Vehicles Act, 1988 challenging the judgment and award dated 23.04.2016 passed in MVC Nos.824/2015 and 825/2015 respectively, on the file of the XIII Additional Small Cause Judge and Member, MACT, Bengaluru. 2. Heard the arguments of learned counsel for the both sides. 3. On hearing the arguments of learned counsel for both sides, this Court finds it reasonable to remand the matters to the Tribunal with a specific direction to grant reasonable opportunity to both parties to adduce evidence and address - 4 - HC-KAR NC: 2026:KHC:27073 MFA No. 866 of 2017 C/W MFA No. 865 of 2017 arguments. The Tribunal shall thereafter dispose of the matters on merits, after duly considering the evidence and arguments of both sides, within a period of two months from the date of receipt of a copy of this order, as the matters are pertaining to the year 2017, both counsels are directed to co-operate with the Court for disposing case within stipulated time. Accordingly, the matters are allowed and remanded. The Registry is directed to transfer the records to the Tribunal within ten days. Both parties are directed to appear before the Tribunal on 29.06.2026. The amount in deposit shall be transferred to the MACT.
