That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to Crime No.64/2025 registered at Police Station Baikunthpur, District Koriya (C.G.) from the respondents. 10.2. That, this Hon'ble Court may kindly be pleased to direct the respondent no.5 to complete the investigation of First Information Report bearing Crime No.64/2025 registered for the commission of the offence which is punishable under Sections 329, 331(4) and 305 of the Bharatiya Nyaya Sanhita, 2023 and submit Final Report Under Section 193 of the Bharatiya Nagarik Suraksha Sanhita, 2023 within a stipulated time framed by this Hon'ble Court. 10.3. Any other order(s), direction(s) and relief(s) which this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case may also kindly be granted in favour of the petitioner.” 2 Facts of the case as projected by the petitioner is that, the petitioner is Director of M/s Maa Vaishno Associates Pvt. Ltd. and the owner and possession holder of House No.93, Khasra No.243/3, situated at MLA Nagar Colony, Baikunthpur, District Koriya, which was being utilized as godown. On 19.04.2024 the petitioner made a written complaint before the police authority stating that while he was in judicial custody, the accused Ram Kumar Ravi and his wife Rimpal Singh illegally broke the lock of said premises and unauthorizedly occupied the same and sold the articles belonging to petitioner worth Rs.6,50,000/-. Despite complaint when no FIR was registered against the accused persons, the petitioner filed an application under Section 175 (3) of BNSS before the Chief Judicial Magistrate, Baikunthpur (in short, CJM), who, in turn, directed the police to submit status report with regard to registration of 3 FIR and finally FIR being Crime No.64 of 2025 was registered on 03.02.2025 against the accused persons for the offence under Sections 329,331(4) and 305 of BNS with respect to illegal trespass, house breaking and theft. Though FIR was lodged on 03.02.2025, however, till date neither investigation is completed nor police has filed Final Report before the competent Court. Therefore, by way of this petition the petitioner seeks a direction to complete the investigation at the earliest. 3 Learned counsel for the petitioner would submit that despite lapse of substantial time from the date of incident; registration of FIR and representations having been made on 05.06.2025 and 03.02.2026 requesting expeditious completion of investigation, no charge-sheet/ final report has been filed by the police till date before the competent court of law. The petitioner apprehends that investigation is not proceeding in a fair and proper manner. He would further submit that inaction and delay on the part of police authorities is causing grave prejudice to the petitioner and defeating the cause of justice. Therefore, the petitioner has approached this court for issuance of a direction to the concerned police authority to complete the investigation forthwith. 4 Having Considered the contentions put forth by the counsel for the petitioner, considering the fact that alleged incident of house trespass and theft took place on 19.04.2024 and FIR having been lodged by the petitioner on 03.02.2025 that too on an application filed by the petitioner under Section 175(3) BNSS before the CJM, Baikunthpur, till date there is no substantial progress and the police authorities have 4 not submitted Final Report under Section 193 of BNSS, therefore, the Superintendent of Police, Baikunthpur, District Koriya, is directed to ensure that investigation of Crime No.64/2025, registered at Police Station, Baikunthpur, is carried out in a time bound manner and the same be concluded within a period of six weeks from today. 5 With the aforesaid observations/direction, the present petition stands disposed of.
