The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950 assailing the order dated 25th February, 2026 passed by the learned Trial Court in case bearing No. CS DJ No. 258/2015, whereby the application under Section 114 read with Section 151 of Code of Civil Procedure, 1908 for recalling of the order dated 21st January, 2026, has been dismissed.
3. During the course of arguments, learned counsel for the petitioner submits that he seeks leave of the Court to withdraw the present petition as it suffers from certain technical defects. It is prayed that the present petition may be disposed of as withdrawn with liberty to file afresh.
