1. Heard Mr. Niraj Baghel, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Additional Advocate General for the State/ respondent No. 1 as well as Mr. Sudhanshu Upadhyay, learned counsel for the respondent No. 2.
2. By this petition under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023, the petitioner seeks modification of the typographical error that has crept in the order dated 06.05.2026 passed by this Court in Cr.M.P. No. 1245/2026.
3. Mr. Baghel, learned counsel appearing for the petitioner submits that vide
order dated 06.05.2026, passed by this Court in Cr.M.P. No. 1245/2026, this Court, while allowing the said petition, was pleased to observe at paragraph 10 as under:
“10. In view of the aforesaid facts and circumstances, particularly the amicable settlement arrived at between the parties and the stand taken by respondent No. 2, this Court is of the considered view that continuation of criminal proceedings arising out of FIR No.166/2022 registered at Police Station Azad Chowk, Raipur, for offence under Section 420 IPC would amount to an abuse of process of law. Accordingly, the said FIR and all consequential proceedings including charge-sheet and cognizance taken thereon are hereby quashed on the basis of compromise between the parties.”
4. Mr. Baghel submits that there is an inadvertent typographical error in the
3 said portion of the order as the FIR/Crime Number has wrongly been mentioned as “166/2022” which in fact should have been “167/2022”. Hence, this petition seeking modification to the said effect.
5. Learned counsel appearing for other side do not controvert the above submission made by learned counsel for the petitioner and submit that this petition may be allowed by modifying the FIR/Crime No. ‘166/2022’ as ‘167/2022’.
6. Though the petitioner has prayed for correction of the FIR number appearing in paragraph No. 10 of the order, however, from perusal of the
order dated 06.05.2026 passed by this Court, it transpires that the FIR number has wrongly been mentioned in paragraphs No. 3 and 8 also which needs to be corrected.
7. Hence, it is hereby directed that in paragraphs No. 3, 8 and 10 of the
order dated 06.05.2026 in Cr.M.P. No. 1245/2026, the words appearing
“FIR No. 166/2022” be read as “FIR No. 167/2022”.
8. Accordingly, the present petition stands allowed.
