In this writ petition, the petitioner has prayed for direction upon the respondent to issue Land Possession Certificate (LPC) for the land of 4 Katha 8 Dhur i.e. 4950 sq. feet (11.36 decimal) with two storied building on 100 sq. ft. out of all that piece of parcel of unserveyed basauri transferable land areas 8 Katha 16 Dhur i.e. 9900 sq. ft. i.e. 22.72 decimal at Madhupur Bazar (Lord Sinha Road), Thana No. 269, under Thoka No. 175 under Madhupur Municipal Ward No. 13, P.O. & P.S.-Madhupur, Dist.-Deoghar, Jharkhand, as the petitioner wants to sell the land without LPC, the respondents are not registering the sale deed. 3. The issue as to whether the LPC is necessary or not for executing the sale deed has been taken note of by Co-ordinate Bench of this Court in W.P.(C ) No. 75 of 2025 (Dhiraj Kumar Sah Vs. State of Jharkhand & Ors.) in paragraph 25 of the judgment. After discussing several provisions of law and referring the judgment of Hon’ble Supreme Court, the Co-ordinate Bench of this Court has held that the requirement of LPC for carrying out the registration is not legal. Further in paragraph 26, it has been held that the Registering Authority shall not demand LPC for registering any document. Paragraph 25 and 26 of the said judgment read as under: -
“25. Consequently, the requirement of Land Possession Certificate for carrying out registration is held to be illegal. The committee for the purpose of granting the Land Possession Certificate is also declared to be illegal and without jurisdiction. 26.
It is made clear that the Registering Authority shall not demand a Land Possession Certificate for the purpose of registering any document presented before it.”

Thus, in view of the aforesaid judgment, passed in W.P.(C) No. 75 of 2025, the respondents cannot insist the petitioner for production of Land Possession Certificate for registering the land in question. 5.
