No.109 of 2015, accused No.1 preferred the present Criminal Appeal under Section 374(2) of the Code of Criminal Procedure, 1973. 2. Today, when the matter is taken up, learned counsel for the appellant submits that during the pendency of the present appeal, the appellant/A.1 died and, therefore, the appeal is liable to be dismissed as abated. 3. On the other hand, the learned Additional Public Prosecutor also confirms the factum of death of the appellant. In fact, the death of the appellant/A.1 was already recorded in the common judgment of this Court in Crl.A.No.272 of 2018 and batch, dated 04.11.2025. 4. In view of the above facts and circumstances, since the appellant/A.1 died during the pendency of the present appeal, the Criminal Appeal is dismissed as abated. Consequently, miscellaneous petitions, if any, pending shall stand closed.
