This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 371 of 2026 to its original file. Learned counsel for the petitioner submits that B.A. No. 371 of 2026 was dismissed for non-prosecution. It is next submitted that as the father of the counsel was ill so the counsel for the petitioner took his father to the hospital for proper treatment hence, he could not appear before this Court when the case was called out and the same resulted in dismissal of B.A. No. 371 of 2026. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 371 of 2026 and unless B.A. No. 371 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 371 of 2026 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, B.A. No. 371 of 2026 is restored to its original file to the stage at which, it was before its dismissal.
