Petitioners have filed this writ petition seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to issue a writ of mandamus and to direct the respondents to release the fund under CRMC scheme and to provide the amount of incentive to the petitioners for the duty rendered by them as Medical Officer during their posting at Community Health Center, Jhalmala and Pandariya, District- Kabirdham (C.G.). 10.2 That, this Hon’ble Court may kindly be pleased to issue a writ of mandamus and to direct the respondent no. 3 to take decision on the representation made by the petitioners for providing their pending incentive under the CRMC scheme. 10.3 That, this Hon’ble Court may kindly be pleased, to grant any other relief/relief’s in favour of the petitioners, which the Hon’ble Court deemed fit & just in the facts and circumstances of the case.” 2. Learned counsel for petitioners submits that according to the policy formulated by the respondent No. 3, the medical officers who are working on deputation with respondent No. 3 are entitled for the amount of incentive under CRMC scheme. This scheme was brought in after 2016, petitioners were posted with respondent No. 3 in the year 2019, however, the petitioners have received their incentives till the year 2020 but thereafter they have not received the CRMC incentives from the year 2021. 3. Learned counsel for the respective respondents submits that the petitioners are seeking the relief under the CRMC, however, petitioners had not submitted representation before the concerned 3 respondent authorities i.e. the respondent No. 3 and and 4 and if petitioners submits such representation, it will be considered and appropriate decision will be taken. 4. On due consideration of the submissions of counsel for the respective parties, the writ petition, at this stage is disposed of permitting petitioners to submit fresh comprehensive representation along with all supporting documents before respondent No. 3 and 4 and if such a representation is submitted, the concerned authorities shall consider and take decision on the representation to be submitted by the petitioners, in accordance with law, expeditiously, preferably within a further period of three months from the date of receipt of copy of the representation.
