Order No.
ORDER 21.05.2026
02.
1. Heard.
2. The petitioners are seeking pre-arrest bail in connection with Marshaghai P.S. Case No.87 of 2026 corresponding to G.R. Case No.484 of 2026 registered on the allegation of the offences under Sections 126(2)/115(2)/76/296/351(2)/3(5) of B.N.S., 2023 pending in the Court of the learned S.D.J.M, Kendrapara.
3.
Learned counsel for the petitioners, on instruction from the petitioners, submits that, except the present bail application, no other bail application of the petitioners are pending in any other Court relating to the aforesaid F.I.R. p. 2
4. The prosecution case, in brief, is that the informant lodged a written F.I.R. before the P.S. stating that on 20.02.2026 at about 9:00 P.M., she, along with her mother-in-law, heard a quarrel taking place in the neighbourhood. They went there and attempted to pacify the parties and requested them not to quarrel. At that time, the accused Gunanidhi @ Gunia (petitioner no.2) allegedly abused the informant in obscene language. When the informant protested against such behaviour, Gunanidhi called his sister-in-law, who also abused the informant in obscene language and allegedly pushed her by the neck, causing her to fall down. It is further alleged that Gunanidhi kicked the informant on her chest. When the informant attempted to get up, accused Naresh (petitioner no.1) allegedly threatened to rape her. The accused Gunanidhi is further alleged to have pressed her neck, torn her blouse, and continued abusing her, while accused Naresh threatened to assault her. Hence, the F.I.R.
5. Regard being had to the nature of allegation against the petitioners, I am inclined to grant the p. 3 petitioners on anticipatory bail. Accordingly, it is
directed that in the event the petitioners are arrested, they shall be released by the Arresting Officer subject to the verification of the criminal antecedent of similar nature. The release of the petitioners shall also be subject to the conditions that they shall cooperate with the investigation and shall appear before the I.O. as and when their presence is required for the purpose of investigation. Violation of any of the conditions shall entail cancellation of bail.
6. With this observation, the ABLAPL is disposed of.
