THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Sri. B.L.Sanjeev, learned counsel, has appeared for respondent Nos. 1 and 2. Hence, Registry is directed to delete the name of B.S. Karthikeyan, as that appearing for respondent Nos.1 and 2. 2. Petitioner is before this Court seeking for the following reliefs: a) Issue a writ in the nature of mandamus directing the Respondents to consider representations dated 20.06.2024 submitted by the Petitioner at ANNEXURE G & H and consequently direct the Respondents to release the remaining amount of Rs. 48,53,119/-(Rupees Forty Eight Lakhs Fifty Three Thousand One Hundred Nineteen only) as against the final tax invoice no.307 dated 18.07.2020 at - 3 - HC-KAR NC: 2026:KHC:11589 WP No. 13257 of 2025 ANNEXURE- E with applicable contractual interest so as petitioner is concerned. b) Pass any order or direction as this Hon'ble Court deems fit under the circumstances of the present case in the interest of justice and equity. 3. The grievance of the petitioner is that the representation which has been submitted by the petitioner for payment of the monies claimed under the various invoices submitted by the petitioner has not been considered by the respondents. 4. Whenever any bills are submitted by the contractor to an employer, it is required for the employer to consider the same in terms of work order and contractual documents and pass necessary orders either by accepting or rejecting the claim made, necessarily in either case to be accompanied by reasons. 5. In the present matter, the bills have been raised in terms of Annexure-E on 18.07.2020. Thereafter, representation has been submitted on 26.02.2024 at - 4 - HC-KAR NC: 2026:KHC:11589 WP No. 13257 of 2025 Annexure-G and H. Both of them have remained unconsidered. As such, I pass the following: ORDER i) Writ petition is allowed. ii) A mandamus is issued directing the respondents to consider the invoices at Annexure-E and the representations at Annexures-G and H in terms of the work order and any contractual documents entered into between the parties and pass necessary orders within 30 days from the date of receipt of a copy of this order. iii) It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner.
