Versus The State of Jharkhand ... … Respondent

HON'BLE MR. JUSTICE ARUN KUMAR RAI

02/13.07.2026 Heard Mr. Amitesh Kumar Geasen, learned counsel for the appellant and learned A.P.P. for the State.
This appeal is directed against the order dated 29.04.2026 passed in B.P. No. 406/2026, arising out of Bariyatu P.S. Case No. 63/2025, by the learned Additional Judicial Commissioner-XVII, Ranchi, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that when the informant and his bodyguard were travelling on his vehicle, two miscreants had opened fire, as a result of which, the informant was shot at his neck and hand. The bodyguard of the informant retaliated at which the miscreants had fled away.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confession of co-accused. Learned counsel for the appellant submits that in similar circumstances some of the co-accused have been granted bail by this Court in Criminal Appeal (D.B.) No. 943 of 2025 and Criminal Appeal (D.B.) No. 1148 of 2025. Learned
counsel adds that the appellant is in custody since
19.03.2026.
Learned A.P.P. though has opposed the prayer for bail of the appellant but has accepted the fact that the implication of the appellant seems to be on the disclosure made by the co-accused persons.
Regard being had to the above, we while setting aside the order dated 29.04.2026 passed in B.P. No. 406/2026, arising out of Bariyatu P.S. Case No. 63/2025, by the learned Additional Judicial Commissioner-XVII, Ranchi, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Judicial Commissioner-XVII, Ranchi in connection with Bariyatu P.S. Case No. 63/2025.
This appeal stands allowed.
