JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayers: “a) Issue a writ of mandamus or any other appropriate writ, order, or direction directing the respondents to consider and grant extension of General parole to the petitioner's son, namely Nasir Hyder @ Nasir (CTP No. 14784), in accordance with the provisions of the Karnataka Prisons and Correctional Services Manual, 2021, on humanitarian and medical grounds; b) Pass an order or direction in the nature of a writ of mandamus directing Respondent No. 2 to release the Petitioner's son, Nasir Hyder @ Nasir (CTP No. 14784) on extension of General Parole; - 3 - HC-KAR NC: 2026:KHC:25252 WP No. 15000 of 2026 c) Grant such other order or direction as this Hon'ble Court may deem fit to grant under the facts and circumstances of the case, in the interest of justice and equity.” 2. The writ petition is filed seeking a direction to the respondents to extend the parole granted to the petitioner's son, who is presently in judicial custody. 3. Learned counsel for the petitioner submits that parole was initially granted on medical grounds and that the petitioner’s son, being the only son, is required to take care of the petitioner. It is further submitted that though an extension of parole was sought and the same was rejected without any basis. 4. Learned AGA, who accepts notice on behalf of the respondents, on instructions submits that after the parole period, son of the petitioner is now in jail. It is submitted that if the petitioner's son requires parole, he has to approach the concerned with an appropriate application and the question of extension of parole does not arise. 5. It is rightly submitted by the learned AGA that the petitioner's son is already in custody after the parole period expired. If the petitioner's son requires parole again, he has to go through the procedure as contemplated under the Karnataka Police Act. In the light of the above submission, the petitioner is not entitled for any relief in this writ petition. 7. In that view of the matter, this Court is passing the following: ORDER i) Accordingly, the writ petition is disposed of, giving liberty to the petitioner to avail the appropriate remedy in accordance with law. i) Pending IAs., if any, shall stand closed.
