The petitioner has preferred this writ petition against the award passed by the learned Commissioner Employees Compensation Act-cum-Labour Court, Janjgir, District Janjgir-Champa (C.G.) under the provisions of the Employees Compensation Act, 1923, wherein, liability has been fastened with the petitioner -2- herein/owner of the vehicle and against such award, this writ petition has been preferred. 2. The award passed under the provisions of the Employees Compensation Act, 1923 is appealable and therefore, this writ petition is not maintainable. 3. At this stage, learned counsel appearing for the petitioner would seek permission of this Court to withdraw this petition with liberty to avail remedy available under the law. 4. Permission is granted. 5. With the liberty as prayed for, the present petition is dismissed as withdrawn. 6. Certified copy be returned after retaining its xerox copy.
