City Civil & Sessions Judge, Bengaluru City, arising out of Crime No.226/2018 registered by Kalasipalya Police Station, Bengaluru City, for the offences punishable under Sections 143, 147, 148, 302 IPC and Sections 27 & 27(a) of the Arms Act, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. Perusal of the material on record would go to show that on the merits of the case, petitioner was earlier granted regular bail by the coordinate bench of this Court in Crl.P.No.8057/2019 disposed of on 02.12.2019. For the reason that petitioner and other accused had misbehaved in the court and their mobile phone was ringing, the learned Trial Judge has taken them to custody on 25.03.2026. Bail application filed by the petitioner and other accused was subsequently rejected by the learned Trial Judge by order dated 01.04.2026. Undisputedly, the bail bonds submitted by the petitioner before the Trial Court in the present case was not cancelled at any point of time. Only for the reason that the accused persons had misbehaved in the Open Court, they have been taken into custody on 25.03.2026. Their bail applications were subsequently rejected by the Trial Court. Accused nos.1 & 2 had, therefore, approached this Court in Crl.P.No.6967/2026 which was allowed on 19.05.2026. Under the circumstances, I am of the opinion that on the ground of parity, petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.1799/2018 pending before the Court of LXVII Addl. City Civil & Sessions Judge, Bengaluru City, arising out of Crime No.226/2018 registered by Kalasipalya Police Station, Bengaluru City, for the offences punishable under Sections 143, 147, 148, 302 IPC and Sections 27 & 27(a) of the Arms Act, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the - 4 - HC-KAR NC: 2026:KHC:27799 CRL.P No. 6037 of 2026 likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
