JUSTICE LALITHA KANNEGANTI ORAL ORDER The petitioner is seeking the following prayer: a) Issue a Writ of Certiorari or any other appropriate writ, order, or direction, quashing the order dated 12/03/2026 passed by the Respondent No.3. (Assistant Commissioner, Mangaluru Sub Division) in Case No.LDRUC/NCR-04/2025 vide Annexure –A. b) Grant such other and further reliefs as deemed fit in the facts and circumstances of - 3 - HC-KAR NC: 2026:KHC:25334 WP No. 16044 of 2026 the case, in the interest of justice and equity.” 2. Learned counsel for the petitioner submits that the order dated 12.03.2026 of Assistant Commissioner was questioned before the Deputy Commissioner. It is the case of the petitioner that the Deputy Commissioner has not taken up the matter on the ground that it is vacation. Hence, the petitioner has come up this Court. 4. Learned AGA appearing for respondents No.1 to 4 on instructions submits that the said submission made by the learned counsel for the petitioner is not correct. In fact they are taking up the appeals and hearing the matters. Considering the submissions of the learned AGA this Court is passing the following: ORDER (i) The Writ Petition is disposed of directing the respondent - Deputy Commissioner to take up - 4 - HC-KAR NC: 2026:KHC:25334 WP No. 16044 of 2026 the matter and hear the same in accordance with law. (ii) He shall consider the I.A. within one month from the date of receipt of copy of this order. (iii) No notice is issued to the respondent No.5 as no adverse orders are passed against him.
