1. This bail application has been filed on behalf of the accused- petitioner under Section 483 of BNSS in connection with FIR No. 584/2025 registered at Police Station Udhyog Nagar, District Sikar for the offence(s) under Sections 318(4) & 61(2)(a) BNS, Sections 3 & 4 of Rajasthan Public Gambling Ordinance Act and Section 5/9 of The Prohibition and Regulation of Online Gaming Act, 2025.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case; nothing has been recovered from the possession of petitioner; He further submits that petitioner is in custody since 12.02.2026; similarly situated co-accused persons Ashish and Naveen Kumar have been enlarged on bail by the Co-ordinate Bench of this Court, vide order dated 18.12.2025 in S.B.Criminal Miscellaneous Bail Application No.
[2026:RJ-JP:12932] (2 of 3) [CRLMB-3851/2026] 15754/2025; conclusion of trial may take a long time, and no fruitful purpose would be served by keeping the petitioner behind the bars and, therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS.
3. Per contra, learned Public Prosecutor vehemently opposes the bail application.

Having regard to the totality of the facts and circumstances of the case and considering the fact that petitioner is behind the bars since 12.02.2026; the main allegation is not attributed to accused-petitioner and similarly situated co-accused persons Ashish and Naveen Kumar have been enlarged on bail by the Co- ordinate Bench of this Court; trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Niranjan Kumar @ Pandit S/o Ashok Kumar is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
6. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner.
