Imam Mr. Soumya Basu Roy Chowdhuri … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year three months and the victim on her own volition fled away with the present petitioner. Subsequently, the present petitioner was implicated in connection with the instant case. Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the statement of the victim under Section 164 of the Cr.P.C. I have taken into account the overall circumstances but I am of the view that the evidence of the victim is required in this court for taking an appropriate decision, as such, at this stage, I am not inclined to enlarge the petitioner on bail. 2 Hence, the prayer for bail of the petitioner is Rejected. The petitioner will renew his prayer for bail after the evidence of the victim is over. The trial is being delayed because one of the accused is absconding. The learned trial court is directed to split up the trial of the case and proceed to the stage of consideration of charges. Priority be given for recording the evidence of the victim. Accordingly, CRM(M) 2455 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record.
