Heard Mr. Rohan Mazumdar, the learned counsel for the petitioner and the learned A.P.P.
This application is directed against the order dated 05.06.2026, passed by the learned Special Judge, Children Court, Dhanbad in Criminal Appeal No. 113 of 2026, whereby and whereunder, the order dated 05.05.2026, passed by the learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Barwadda P.S. Case No. 40 of 2025 rejecting the prayer for bail of the petitioner has been affirmed. It has been alleged that the petitioner and other co-accused persons had committed assault upon the brother of the informant which resulted in his death. Submission has been advanced by the learned counsel for the petitioner that the allegations are general and omnibus in nature and considering the said fact, two of the co-accused persons have been granted bail in B.A. No. 4948 of 2025 and B.A. No. 8571 of 2025. It has been submitted that the petitioner is in custody since 28.01.2026 and the social investigation report is not adverse to the cause of the petitioner. Learned A.P.P. has opposed the prayer for bail made by the petitioner. Apart from the allegations being general and omnibus in nature which resulted in the grant of bail to some of the co-accused persons, as noted above, the social investigation report was also supportive of the
fact that the behaviour of the petitioner is cordial and in fact, the petitioner has been sucked into the vortex of criminal activity on account of mixing with bad elements. In fact, the mother of the petitioner has given an undertaking before the learned Court-below also that she shall ensure that the petitioner is kept away from anti-social elements.
On consideration of the aforesaid facts, the order dated 05.05.2026, passed by the learned Principal Magistrate, Juvenile Justice Board, Dhanbad in connection with Barwadda P.S. Case No. 40 of 2025 and the order dated 05.06.2026, passed by the learned Special Judge, Children Court, Dhanbad in Criminal Appeal No. 113 of 2026 are hereby quashed and set aside. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Children Court, Dhanbad in connection with Barwadda P.S. Case No. 40 of 2025, subject to the condition that the mother of the petitioner shall ensure the safe keep of the petitioner and shall further ensure the petitioner is kept away from anti-social elements. This application is allowed. (RONGON MUKHOPADHYAY, J.) 10.07.2026 S.B Uploaded on 13.07.2026
