The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 04/2026, registered at Police Station – Utai, District – ABHIGYA SAXENA Digitally signed by ABHIGYA SAXENA
2 Durg (C.G.) for the offence punishable under Sections 109, 296, 115(2), 351(3), 3(5), 191(2), 191(3), 324(1) and 112 of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2. Prosecution story, in brief, is that on 03.01.2026 at about 10:00 PM, the complainant, Tikam Sahu, along with his friend, had gone to Village Kokdi on a motorcycle to watch a Jasgeet programme. It is alleged that while returning on 04.01.2026 at about 12:30 AM and proceeding from Kokdi towards Paupara, upon reaching near the sugarcane field (Ganna Badi), they noticed that an accident had taken place. When the complainant inquired about the said incident, the persons present there allegedly started accusing them of having caused the accident and thereafter abused and assaulted them. It is further alleged that due to the said assault, both the complainant and his companion sustained injuries on their hands and legs. On the basis of the aforesaid report, the police registered the offence against the present applicant and other co-accused persons. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case and there is no criminal antecedents registered against the present applicant. It is further submitted that the charge-sheet has been filed in this case. He further submits that the case of the present applicant is distinguished from the co-accused as there is no allegation on the applicant for causing injuries to the injured.
3 The applicant is in jail since 05.01.2026 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that there is no criminal antecedents registered against the present applicant, and the charge-sheet has been filed in this case. It is further submitted that the injuries sustained by the injured are grievous in nature and the bail of the co-accused has already been rejected by this Court, therefore, the present applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. Taking into consideration the facts and circumstances of the case, particularly the nature and gravity of the allegations levelled against the applicant, the fact that no criminal antecedents are registered against the present applicant, and that the charge- sheet has already been filed, however, considering the manner in which the alleged offence is stated to have been committed, which prima facie reflects the seriousness of the offence, this Court is not inclined to allow the present application. 7. Accordingly, this bail application of applicant – Nitesh Kumar @ Lalli involved in Crime No. 04/2026 registered at Police Station – Utai, District – Durg (C.G.) for the offence punishable under
4 Sections 109, 296, 115(2), 351(3), 3(5), 191(2), 191(3), 324(1) and 112 of the Bharatiya Nyaya Sanhita, 2023 (BNS), is rejected at this stage. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
