1. The petitioner has filed the present writ petition praying for the following reliefs: 10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner from the office of respondent no. 1 and respondent no. 2 by issuing a writ of certiorari and after perusal of such records further be pleased to command respondent no. 1 and 2 to direct them to include the name of the petitioner in the promotion/gradation list or they be
directed to grant ad-hoc promotion subject to decision of the pending Writ Appeal No. 608 of 2022 by issuing a writ of mandamus in the ends of
3 justice. 10.2 The Hon’ble Court be pleased to grant any other writ, order or directions in the circumstances of the case in favor of the petitioner.
2. Learned counsel for the petitioner submits that petitioner is working on the post of Sub-Engineer and is working within the territory of State of C.G. since 1989, however due to the pending dispute of the allocation of service of the petitioner, name of the petitioner could not be considered for promotion. He submits that as of now the dispute with regard to allocation of service has now been finalised by the order dated 12.05.2026 passed by the State Government, petitioner may be permitted to submit a fresh representation raising all the grounds as raised in this writ petition before respondent no. 1 and 2 and direction be issued to the concerned authority to consider and take decision on the representation submitted by the petitioner at the earliest within the specified time frame.
3. Counsel for the State submits that in view of the limited prayer made by the counsel for the petitioner she is having no objection.
4. I have heard learned counsel for the respective parties.
5. On due consideration of submission of counsel for respective parties and further considering the fact that the State government has passed the order on 12.05.2026 allocating the services of the petitioner in the State of C.G. the writ petition at this stage is
disposed of permitting the petitioner to submit a fresh
4 comprehensive representation raising all the grounds as raised in this writ petition and enclosing the documents in this regard and in the event such a representation is submitted before respondent no. 1 and 2, the concerned authorities shall consider and take decision on the representation to be submitted by the petitioner in an objective manner in accordance with law expeditiously preferably within a further period of 3 months from the date of receipt of representation.
6. Accordingly, the present writ petition stands disposed of.
