Rakib (Allowed) CRM (NDPS) 320 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 8 of 2026 dated 02.01.2026 under Sections 21(C)/29 of the NDPS Act. And In the matter of : Pappu Singha & Anr. ……Petitioners. Mr. Arup Kumar Bhowmick .....for the Petitioners. Mr. Somnath Adhikary ……for the State. Learned advocate appearing for the petitioners submit that the petitioners are arrested on 02.01.2026 and allegedly from their possession 15 bottles of phensedyl and 107 grams of brown sugar were recovered. According to the learned advocate there has been no progress in the investigation and the petitioners are in custody for more than four months. Mr. Somnath Adhikary, learned advocate appears for the State. His appointment may be regularized by the concerned authorities. Learned advocate for the State opposes the prayer for bail. Having considered the quantum of alleged seizure and the fact that the Case Diary reveals that except for the purposes of receipt of the Chemical Examiner’s Report the investigation primarily seems to be towards its end, I am of the view that further 2 detention of the present petitioners is unwarranted. Accordingly, the prayer for bail of the petitioners is allowed. As such, petitioners namely, Pappu Singha and Raju Singha shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Court under NDPS Act cum Additional District Judge, 3rd Court, Malda. If on bail, the petitioners shall be physically present on each and every date fixed by the learned Special Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Additionally, petitioners would meet with the investigating officer of the case once in a week till the charge-sheet is submitted before the jurisdictional Court. Accordingly, CRM (NDPS) No. 320 of 2026 is allowed. Memo of evidence submitted by the State is kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
