For Petitioner: Mr.V.Raghavachari, Senior Counsel for Mr.Ma.P.Thangavel For Respondents: Mr.Stalin Abimanyu Additional Government Pleader ORDER This petition has been filed forbearing the 3rd respondent and his subordinates not to interfere with the querying ordinary earth from WRD Tanks for bonafide public purpose as per the orders passed by the 1st respondent in Na.Ka.No. 219/ Mines/ 2025, dated 02.12.2025 for the period from 14.03.2026 to 22.05.2026 pursuant to the order passed by the 2nd respondent in Rc No. 320/Mines/ 2025-EAC 2/02 dated 24.11.2025 so as to enable petitioners to __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 14340 of 2026 complete the project of Gravel Quarry from Karmapurm Village Lake, in SF No.121, WRD Tank, Karmapuram Eri, Thiruchengode Taluk, Namakkal District 2.The learned Senior Counsel appearing for the petitioner would submit that the petitioner obtained permission from the first respondent under Section 7 of the Tamil Nadu Minor Minerals Concession Rules, for the removal of 5000 square meters of ordinary earth for a road project vide order dated 02.12.2025 and also obtained bulk transport permit on 17.03.2026. Despite the order passed by the first respondent, the third respondent interfered with the petitioner’s operations. Hence, the present writ petition has been filed. 3.The learned Additional Government Pleader appearing for the respondents would submit that the petitioner had removed ordinary earth in excess of the quantity permitted by the first respondent. However, it is submitted that the third respondent will report the matter to the first respondent for passing appropriate orders. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 14340 of 2026 4 In view of the above, the third respondent is directed to strictly adhere to the terms of the license granted by the first respondent, namely, the District Collector, Namakkal District in favour of the petitioner. 5.With the above direction, this Writ Petition stands disposed of.
