The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers:- “It is therefore humbly prayed that the Hon'ble Court may kindly be pleased to quash the FIR bearing FIR and Crime No.- 582/25 dated 4/12/25, registered at Police Chowki- Surgi, PS- Basantpur, District- Rajnandgaon, CG along with charge sheet bearing No.116/26 dated 5/4/26 against the present petitioner for offence u/s 108, 3 (5) of BNS which is a gross abuse of process of law, illegal and against the provision of law and thus, liable to be quashed in the interest of justice. The Hon'ble Court may kindly be pleased to quash the order taking cognizance dated 27/4/26 passed by the Court of Judicial Magistrate, First Class, Rajnandgaon, District-Rajnandgaon, CG in Criminal Case No.-715/26 in the interest of justice. The Hon'ble Court may kindly be pleased to quash the entire criminal proceedings initiated against the petitioner bearing Criminal Case No.- 715/26 pending before the court of Judicial Magistrate, First Class, Rajnandgaon, District- Rajnandgaon, CG in the interest of justice. Any other relief which this Hon'ble Court deem fit and proper may also kindly be granted to the petitioners in the interest of justice.” 3 3. After arguing for some time, learned Senior Advocate appearing for the petitioner seeks permission of this Court to withdraw the present petition, with liberty to raise all necessary objections/pleas before the learned Trial Court at the time of framing of charge, as raised in the present petition. 4.
