PATTANAIK Order No. ORDER 30.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with Kharbelanagar P.S. Case No.33 of 2026 corresponding to C.T. Case No.l23 of 2026 pending in the file of learned S.D.J.M., Bhubaneswar on the grounds stated. 3. Perused the FIR as at Annexure-1. A copy of the seizure memo is at Annexure-2 and Mr. Paul, learned counsel for the petitioner submits that such seizure is of the stolen mobile and it was made from one Chandan Jena, who is the co- accused and on his disclosure, the petitioner apprehends arrest but he has having no other similar antecedent and therefore, the Court should allow him to go on bail with any conditions, which is objected by Mr. Panda, learned ASC for the State. Gone through the FIR i.e. Annexure-1. Admittedly, from Annexure-2, such seizure is revealed and it was from the co- accused named above. Recording the submission of Mr. Paul, learned counsel that the present accused does not have any similar antecedent and objection of the State, though, this Court is not inclined to consider plea for pre-arrest bail but is of the view that he should be directed to surrender before the learned court below for being released with suitable conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M., Bhubaneswar within fortnight from today, it is directed that he shall be released on bail in connection with Kharbelanagar P.S. Case No.33 of 2026 corresponding to C.T. Case No.123 of 2026 on furnishing a bail bond of Rs.25,000/-(rupees twenty five thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case subject to absence of any antecedent of similar nature against him. 6.
