JUSTICE E.S.INDIRESH ORAL ORDER Heard the learned counsel appearing for the parties. 2. In this writ petition, petitioner is assailing the order dated 28.10.2024 in Cop.Appeal No.224 of 2019 (Annexure-A) on the file of the Karnataka Appellate Tribunal, Bengaluru. 3. Having taken note of the submission made by the learned counsel appearing for the parties, on careful consideration of the observation made by the Tribunal at paragraph No.11(6) of the impugned order at Annexure-A, it would indicate that, after the receipt of the inquiry report under Section 64 of the Karnataka Co-operative Societies Act, 1959, the Petitioner-Society ought to have issued the notice along with the inquiry report to the delinquent officer, seeking explanation from the petitioner. 4. In that view of the matter, non-issuance of notice to the appellant therein along with the copy of the - 4 - HC-KAR NC: 2026:KHC:14351 WP No. 8571 of 2025 enquiry report, before initiating proceedings under Section 69 of the aforementioned Act is in violation of principles of natural justice. The finding recorded by the Tribunal is just and proper. The impugned order does not call for interference by this Court. In that view of the matter, reserving liberty to the petitioner to issue notice to Respondent No.2 along with the copy of the enquiry report to Respondent Nos.2 to 4.
