Instant writ petition i.e. WPS No. 5077 of 2023 under Article 226/227 of the Constitution of India, has been preferred by the petitioner seeking following reliefs:- 2 10.1 That the Hon’ble Court may kindly be pleased to call for the entire records of the case from the authorities concerned for proper adjudication of the case. 10.2 That that Hon’ble High Court may kindly be pleased to set-aside the compassionate appointment order dated 09.10.2017, issued in favour of Respondent No. 05 in the interest of justice. 10.3 That the Hon’ble Court be pleased to direct the respondent authorities to give compassionate appointment to any other suitable family members of late Jawahar Lal Sahu, as the authority thinks fit and proper and if not then the same should be cancelled, in the interst of justice. 10.4 Any other relief, which this Hon’ble High Court deems fit and proper be also awarded. 2. Earlier also, petitioner – Smt. Basanti Devi Sahu had filed WPS No. 5628 of 2018 {Basanti Devi Sahu vs. The State of Chhattisgarh & others} seeking similar relief, which is reprodued below :- 10.1 That the Hon’ble Court may kindly be pleased to call for the entire records of the case from the authorities concerned for its kind perusal. 10.2 That that Hon’ble High Court may kindly be pleased to set-aside the compassionate appointment order dated 09.10.2017 (Annexure P-1), issued in favour of Respondent No. 5, in the interest of justice. 10.3 That the Hon’ble Court be pleased to direct the Respondent authorities to give compassionate appointment to any other suitable family members of late Jawahar Lal Sahu, as the authority thinks fit and proper, in the interest of justice. 10.4 Any other relief, which this Hon’ble High Court deems fit and proper be also awarded. 3 3. Learned counsel appearing for the petitioner would submit that respondent No. 5 – Manoj Kumar Sahu has obtained compassionate appointment concealing material facts, therefore, earlier the petitioner had filed writ petition being WPS No. 5628 of 2018 seeking aforementioned reliefs. He further submits the petitioner has filed representation dated 05.06.2023 (Annexure P-7) filed before respondent No. 2 -Director, Department of Veterinary Services Raipur, but the has not been decided yet, hence, this petition (WPS No. 5077 of 2023) may be admitted for hearing. 4. On the other hand, learned counsel for the State submits that instant petition filed by the petitioner for similar relief, as was sought for by the petitioner in the previous writ petition i.e. WPS No. 5628 of 2018 is not maintainable, hence, this petition may be dismissed as not maintainable. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Admittedly, in WPS No. 5628 of 2018 (Smt. Basanti Devi Sahu vs. State of Chhattisgarh), this Court, vide its order dated 06.07.2022, directed Respondent No. 5 to pay a sum of Rs. 3,500/- per month to the petitioner—Smt. Basanti Devi Sahu (who is the mother of Respondent No. 5)—on a monthly basis. Subsequently, vide order dated 12.04.2023, the aforementioned writ petition was disposed of in light of the aforesaid order of maintenance. A perusal of the final order dated 12.04.2023 makes it evident that a sum of Rs. 3,500/- is being deducted from the monthly salary of Respondent No. 5, and that normal human relations between them are still in line of progress. 7. Subsequently, the petitioner has filed instant petition seeking similar relief, as was sought for in the previous writ petition i.e. WPS No. 5628 of 2018. Thus, since relief sought for by the petitioner has already been considered by this Court in WPS No. 5628 of 2028 vide order dated 12.04.2023, which was disposed of directing respondent No. 5 (son of petitioner) to pay maintenance of Rs. 3,500/- per month to the petitioner, which is also being deducted from monthly salary of respondent 4 No. 5, therefore, this Court is not inclined to entertain instant petition for similar relief, as was sought for by the petitioner in the previous writ petition i.e. WPS No. 5628 of 2018. 8. Accordingly, this petition fails and is hereby rejected at the motion stage itself. No order as to cost (s).
