JUSTICE SANDEEP KUMAR ORAL ORDER 5 23-06-2026 Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State. 2. The petitioner seeks bail in connection with Chakiya P.S. Case No. 567/2025 registered for the offences punishable under Sections 103(1) and 3(5) of B.N.S. 3. As per the prosecution case, petitioner is accused of killing his wife. 4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. It is next submitted that the deceased died due to heart attack. Learned counsel further submits that he has no criminal antecedent and he is in custody since 05.12.2025. The petitioner undertakes to Patna High Court CR. MISC. No.17734 of 2026(5) dt.23-06-2026 2/2 co-operate in the case/ trial. 5. Learned APP for the State as well as learned counsel for the informant have jointly opposed the prayer for regular bail of the petitioner. Learned counsel for the informant submits that the deceased has four children and she has been killed by the petitioner and because of threats by the accused persons, the witnesses are not able to depose in the trial. 6. Considering the allegations levelled against the petitioner, this Court is not inclined to grant bail to the petitioner. 7. Accordingly, this application stands dismissed. 8. If the informant files an application before the Superintendent of Police, Samastipur for providing protection for their deposition in the trial, appropriate police protection shall be provided to the witnesses by the Superintendent of Police, Samastipur. 9.
