1. By way of this petition, the petitioner has prayed for following RAGHVENDRA JAT Digitally signed by RAGHVENDRA JAT
2 reliefs:-
“10.1 That the Hon'ble Court may kindly be pleased to direct the respondent No. 2 to conclude the pending proceeding of Revenue Case No. 202505111000078 for the subject trust registration case Class-Talibandha B/113(1) Gram Telipara, P.H. No. 64, Tahsil and District Raipur within stipulated time. 10.2 That the Hon'ble Court may kindly be pleased to direct the respondent No. 2 to register the petitioner's trust namely "Divya Jyoti Foundation" Trust within stipulated time. 10.3 Any other relief, which may deem fit, in the interest of justice.”
2. Learned counsel for the petitioner submits that the petitioner has already initiated proceedings for registration of the trust namely
“Divya Jyoti Foundation Trust” before respondent No. 2 in Revenue Case No. 202505111000078 pertaining to Telibandha Case Class-B/113(1), Gram Telipara, P.H. No. 64, Tahsil and District Raipur, however, despite lapse of considerable time, the said proceedings are still pending consideration before the competent authority. It is therefore prayed that this Court may be pleased to direct respondent No. 2 to conclude the pending proceedings and decide the application for registration of the petitioner’s trust within a stipulated period, in accordance with law. 3. Learned counsel appearing for the State submits that he has received instructions from respondent No. 2, namely the Registrar, Public Trust and SDO (Revenue), District Raipur.
On the basis of the instructions so received from the concerned authority, it has
3 been submitted that the application preferred by the petitioner for registration of the trust under the name and style of “Divya Jyoti Foundation Trust” is presently under consideration before the competent authority and appropriate action shall be taken thereon in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Considering the submissions made by learned counsel for the parties and further considering the fact that the application preferred by the petitioner for registration of the trust namely
“Divya Jyoti Foundation Trust” is pending consideration before respondent No. 2, namely the Registrar, Public Trust and SDO (Revenue), District Raipur, this Court deems it appropriate to dispose of the present petition with a direction to the concerned authority to consider and decide the petitioner’s application expeditiously, preferably within a period of 4 months from the date of receipt of copy of this order strictly in accordance with law. It is further observed that if the petitioner is found entitled, necessary steps for registration of the trust shall also be undertaken in accordance with law.
