JUSTICE SANDEEP KUMAR ORAL ORDER 3 23-06-2026 Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State. 2. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 89, 80, 3(5) of the B.N.S. 3. As per the prosecution case, petitioner is the husband of the deceased and he is alleged to have killed the deceased for demand of dowry. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is next submitted that It is further submitted that the deceased committed suicide and that independent witnesses, Patna High Court CR. MISC. No.14317 of 2026(3) dt.23-06-2026 2/3 during the course of investigation, have stated that the deceased had been insisting on being provided with an Android mobile phone and, upon not being given the same committed suicide. Learned counsel further submits that, despite submission of the charge-sheet, no substantial progress has been made in the trial. Petitioner is a man with a clean antecedent and he is in custody since 17.06.2025. The petitioner undertakes to co-operate in the case/ trial. 5. Learned counsel for the informant as well as learned APP for the State have jointly opposed the prayer for regular bail of the petitioner. 6. Considering the statements of the independent witnesses indicating that the deceased committed suicide due to not being provided with an Android mobile phone, the period of custody undergone by the petitioner, and the fact that charges have not yet been framed, this application for regular bail is allowed. 7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Hajipur Sadar P.S. Case No. 353 of 2025 and further subject to Patna High Court CR. MISC. No.14317 of 2026(3) dt.23-06-2026 3/3 the following condition:- (I) the petitioner after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the Trial Court on each and every date fixed by the trial Court. Non- compliance of the condition will result in cancellation of the bail bonds of the petitioner. (ii) till framing of charge, the petitioner is directed to appear on each and every date personally. 8. Learned counsel for the informant assures this Court that the witnesses will be produced in the court below as and when required. 9. The District & Sessions Judge, Vaishali at Hajipur, is directed to ensure that the trial proceeds expeditiously and is concluded at the earliest possible opportunity, in accordance with law. 10.
