Rai, A.C. to G.A.-IV …...... 02/08.07.2026: 1. Heard the parties. 2. Notice has been validly served upon respondent nos. 8 but he has not appeared today. 3. The main prayer of the petitioner as per the writ petition is to pass an order upon the respondents to immediately vacate the room in the new building of the petitioner’s society which has been illegally occupied by respondent no. 8. 4. A report was called for from the State on the point of occupation. 5. Learned counsel appearing on behalf of the State submits today that respondent no. 8 is occupying the said shop. 6. Learned counsel appearing on behalf of the petitioner submits today that the respondent no. 8 is a tenant and the Registrar of the Co- operative society has got no authority or jurisdiction to restore possession of respondent no. 8. He submits that the landlord-tenant dispute should be looked into terms of the Jharkhand Buildings (Lease, Rent and Eviction) Control Act, 2011, where SDO has been empowered to settle the dispute. 7. On query he submits that the complaint made by the respondent no. 8 before the Registrar of the Co-operative Society, clearly suggest that respondent no. 8 has admitted that he is a tenant and he pays rent to the petitioner regularly. 8. From the facts mentioned above and also the submission made by the counsel for the petitioner, it is clear that respondent no. 8 is occupying the shop in question. The petitioner wants his eviction. The petitioner themself admits that respondent no. 8 is a tenant. If that be so, liberty is granted to the petitioner to approach the rent controller under the Jharkhand Buildings (Lease, Rent and Eviction) Control Act, of 2011 seeking eviction of respondent no. 8 from the premises in question. 9.
